Each of the terms appearing below shall have in the present Conditions the meaning assigned thereto, namely:
« Altibus »: Altibus.com Sarl, with a capital 30,500 €, recorded in the National Business and Company Register under number 440 797 371 and registered with the registry of the Commercial Court of CHAMBERY, whose domicile is at 926, avenue de la Houille Blanche 73000 CHAMBÉRY, and is a supplier of a transport ticket, timetable and reservations consultancy service entitled « Reservations Centre ».
« Portail Altibus.com »: An information gateway consisting of Carriers and Altibus Internet sites, making it possible for the user to consult practical information about timetables of bus/coach station connections to winter sports resorts and to reserve tickets via the Reservations Centre.
« User »: A user being an individual of Portail Altibus.com, not acting as a professional, who consults transport timetables and makes online or telephone reservations of transport tickets via the Reservations Centre.
« Carrier »: A transport company for travellers offering car transport connections between bus/coach stations and winter sports resorts in the area covered by Portail Altibus.com.
« Reservations Centre »: Altibus.com consultation, ticket reservation and dispatch service, made online or by telephone by speaking to call centre operators.
« Basket »: Purchase by a customer from Altibus.com, implemented in the form of a specific financial transaction.
The present agreement has the object of providing, on the one hand, the conditions of supplying to users of Portail Altibus a timetable, reservations and dispatch of transport tickets consultation service and on the other hand, the conditions of sale of the said transport tickets.
The present General Conditions of Sale shall apply to services offered by Altibus on behalf of carriers.
Ordering services shall be limited to users, who have noted and accepted by means of clicking on the « I accept the General Conditions of Sale » button of the Altibus Internet site, or if necessary, by telephone, the present General Conditions of Sale in their entirety.
Altibus hereby reserves the right to modify the presents General Conditions at any time without prior notification, it being understood that such modifications shall not apply to reservations already accepted by Altibus earlier.
Every user hereby undertakes to comply with the specific conditions of carriers and in particular, to pay any sums due and to accept the conditions and limitations of liability relating to the availability of the products and services being offered.
4.1
Altibus shall make available to users on the Altibus Internet site, a system of consultation of timetables of the carriers’ connections by car, in the regions covered by Portail Altibus.com.
After consulting the timetables of arrival and departure on the projected date of his/her travel currently in force, the user shall have the option of making a reservation and paying for the selected transport tickets, either via the Altibus Call Centre, by bank credit card, or by cheque.
On receipt of payment, the transport tickets shall be sent directly to the user on the conditions laid down in article 5 hereof.
4.2
Altibus.com service shall be accessible on line on the Altibus internet site, round the clock and 7 days a week.
Nevertheless, due to the nature of the Internet itself, Altibus shall not be able to guarantee the uninterrupted functioning of the service during these periods and hereby declines to accept any responsibility under this head, the user expressly waiving any claim for compensation in respect of any direct or indirect prejudice sustained by him by as a result of the interruption of the service.
The Altibus Internet site shall also be accessible by telephoning the Call Centre, Monday to Friday from 08.00 hours to 18.30 hours and Saturdays from 08.00 hours to 12.00 hours and then from 13.30 hours to 17.00 hours.
5.1.
The user shall not be able to make reservations, or to place orders for transport tickets less or more than 7 days preceding the selected date of departure. For customers using self-pintable tickets, this period shall be reduced to 48 hours preceding the selected time and date of departure.
5.2.
By telephoning the Altibus Call Centre, or communicating directly online with the Altibus Internet site, the customer shall be able to exercise the following options, namely
- the place(s) of arrival and departure
- the dates and times of departure and/or return
- the number of travellers
The user shall then furnish the following information, namely
- the surname, forename and age of each traveller
- the surname, forename, postal address, telephone number and e-mail address of the holder of the bank credit card used for the protected online payment for the transport tickets.
The user shall ensure the provisions of reliable and authentic information at the different stages of the placing of his/her order.
5.3
In the case of an order placed via the Altibus Internet site, the user shall receive on completion of the placing of his/her order, an electronic message accompanied by a *pdf format ticket, according to the conditions laid down in article 6 of the presents General Conditions of Sale.
In the event of any irregularity of reception by e-mail of the self-printable ticket, the user shall contact the Altibus Call Centre before departure.
As an example only, the generation of a self-printable ticket and its automatic dispatch to the e-mail address of the customer, are instantaneous. Nevertheless, certain technical constraints may slow down the process and the receipt of self-printable ticket by the user may take some hours. If the ticket shall not have arrived within an adequate space of time preceding the date of departure, the user shall contact the Call Centre.
The user shall be responsible for printing out his/her self-printable electronic ticket before departure and using his/her own means of printing on A4 white paper which shall be empty on both of its sides (21.0 cm x 29.7 cm), without modification of print size in portrait format (vertical), using a laser or inkjet colour printer. It shall not be able to be supplied on any other support (electronic screen).
Good print quality shall be essential needed; tickets, which are only partially printed out, soiled, damaged or illegible, shall not be accepted on board the vehicle and shall be regarded as invalid. In the case of an incident, or of a bad quality of printout, the *pdf file shall be printed afresh.
5.4.
In the event of a telephone order via Altibus Call Centre, the operator shall give to the user a verbal summary of his/her order, which he/she must accept, if the order is to be correctly recorded.
The number of the order shall likewise be communicated to him/her.
On completion of his/her order, the user shall receive by post a summary of the order, which shall include the number of the order, its description and his/her acceptance, without reservations, of the present General Conditions of Sale.
The transport ticket(s) shall be sent to the user by ordinary mail, to the delivery address stated at the time of placing the order and on the receipt by Altibus of the payment of the order by the user.
In the event of the non-arrival of the transport tickets in good time prior to the date of departure, the user shall contact the Call Centre.
6.1
Prices communicated on Portail Altibus.com shall be shown in € and shall include all taxes and exclude the charges for reservation and dispatch, which shall be payable in addition.
The prices shall be subject to modifications by Altibus at any time.
6.2
Accompanied children aged less than four on the date of travel, shall travel free of charge but without being guaranteed seats.
6.3
Orders placed via the Altibus Internet site, shall be paid for by bank credit card, using solely the SSL protected payment system.
Accepted bank credit cards are identified by an icon at the moment of payment.
Altibus shall guarantee the security and the confidentiality of users data relating to their means of payment.
Altibus has adopted the SSL encryption process, which ensures the reliability of exchanges and transactions by encrypting at the moment of their entry all personal data, which are essential for processing the orders, such as postal addresses, e-mail addresses and bank account details.
6.4
Orders placed via the Altibus Call Centre shall be paid for by a bank credit card, or by cheque to the order of Altibus.com.
6.5.
Whatever the method of payment, transport tickets shall only be sent following the completion of the payment of the price of the order.
The express online validation by the user of the present General Conditions of Sale, followed by the online payment of the transport ticket(s) ordered, shall constitute the entire order.
The user shall be able to have his/her reservation modified up to and including the 7th day preceding the date of his/her travel.
On these conditions, the user shall contact the Altibus Call Centre to which he/she shall communicate his/her order number and the modifications of the reservation.
In the event of the modifications intended to cancel the reservation and implying a reimbursement to the user, the methods of the said reimbursement shall be those set out in article 10.
If the user shall make a reservation less than 7 days prior to the chosen date of departure, he/she shall not be able to modify the reservation, in particular in case of a reservation by means of self-printable tickets, as laid down in article 4.1. of the present General Conditions.
In compliance with article L121-20-4 of the Consumer Code and with article 3 § 2 of European Directive of 20 May 1997, the space of seven days allowed for retraction, shall not apply to the present General Conditions of Sale, the user’s order being therefore regarded as firm, definite and irrevocable, except in the event of a straight cancellation as set out in article 10 of the present General Conditions of Sale.
In the event of loss of and/or failure to use (the) ticket(s) on the date of its/their validity, not be followed by its/their cancellation by the user, the ticket(s) shall be neither exchanged nor its/their price reimbursed, regardless of the method of the placing of the order (Internet site or Call Centre).
10.1.
In the event of an order placed via the Altibus Call Centre, the user shall be able to cancel his/her reservation and apply in writing for the reimbursement of the sums paid, against the return of the ordered and unused transport ticket(s), which shall be appended to the application.
The application for cancellation shall be taken into account and shall become effective from the date of receipt of the user’s cancellation message.
Subject to an absence of objection of the carrier in question, as well as to the non-utilisation, even a partial one, of the transport ticket(s), Altibus shall reimburse the sum paid by bank transfer, the figure of reimbursement being fixed as follows

No refund of the price of the ticket shall be due, if the date of receipt of the application for cancellation shall be later than the date scheduled for the travel, the user then falling into the purview of article 9 of the present General Conditions of Sale.
The to and fro journeys to which return tickets entitle the holder, shall not be able to be dissociated.
Tickets appended to the application for cancellation shall not be modified in any way by erasure or deletion (especially the removal of the detachable coupon), this being a suspensive condition of reimbursement.
10.2.
In the case of an order for a self-printable ticket, the ticket shall be neither able to be reimbursed, nor exchanged.
Altibus hereby guarantees to the user the compliance of the transport tickets furnished to a customer with the summary of the order sent to the user by e-mail, or communicated orally by the operator in the context of an order placed via the Call Centre.
The present contract shall end on the receipt of the transport tickets ordered by the user.
13.1
Altibus shall not provide transport for the user, but only the Altibus.com service set out in article 3.
Transport shall be the sole responsibility of the carrier.
13.2
The reservation of transport tickets via the Altibus.com service shall imply the acceptance of the following transport conditions, applicable by all Altibus.com service carriers, except for specific conditions of carriers, which the user shall comply with, namely
- Control: Warrants and corresponding tickets shall be shown to the driver when boarding the vehicle.
Travellers shall retain their transport tickets throughout the journey and show them to personnel authorised to check the validity of tickets at the moment of the traveller’s boarding or descending from a vehicle.
Any traveller who shall find him-/herself in an irregular situation, shall be liable to a fine of an amount laid down by the regulatory texts in force and whose methods shall comply with the Code of Criminal Procedure (articles 529/4 and 529/5).
- Luggage: The transport of skis and luggage shall be included in the price of the ticket provided they shall be able to be carried by a single traveller. Beyond this, they shall be transported at the tariff for the time being in force. Packages containing dangerous and inflammable substances, or substances of a nature to inconvenience other travellers, shall not be accepted. Luggage other than hand luggage shall be transported in the luggage compartment.
- Animals: Small domestic animals shall be admitted free of charge, provided that they shall be placed in a closed basket and carried on the owner’s lap. Only dogs on a leash shall be admitted and paid for separately. In any event, they shall not inconvenience other travellers. Guide-dogs shall be admitted free of charge.
It is prohibited
- to smoke in vehicles
- to obstruct driving and to speak to the driver
- to open/close emergency exits (except in case of an accident)
- to obstruct the opening/closing of doors
- to deface the installations of vehicles and public information panels
Proper behaviour is required
In compliance with Law on Freedom of Information » n° 78-17 of 6 January 1978 the Altibus site has been declared to CNIL under n° 826413.
Information collected on the terms of the present General Conditions of Sale, permits Altibus to issue tickets to users.
They shall also be able to be used to inform users of the availability of new services.
On the other hand, the said information shall not, in any event, be passed to third parties without the express authorisation of users.
In compliance with the provisions of article 34 of the Law on Freedom of Information, the user shall have a right of access, of modification, of rectification and of the deletion of data. .

Altibus shall not be able to be held responsible for a late compliance or the non-compliance with the present General Conditions by reason of a case of force majeure or Act of God, due to the action of the other party to the contract or of a third party, or to external causes such as social conflict, the intervention of civil or military authorities, natural disasters, strikes, fires, flood damage, the poor functioning or the interruption of the telecommunications, or of electrical networks.
Force majeure shall mean any event outside the control of the affected party, of a character which is both unpredictable, irresistible and not able to be overcome, which shall prevent Altibus from implementing all, or a part, of the obligations attributed to it by the///present///contract. In any event, Altibus shall do everything in its power to limit the duration and the effects of the Act of God, of force majeure or of the exterior cause.
16.1
The present conditions express all the obligations of the parties and
no other general or specific condition shall be able to be incorporated in the present contract.
16.2
If one of the provisions of the present document shall be considered null and void by reason of a present or future legal or regulatory disposition, or that of a qualified Court ruling invested with the authority of a judged case, the said provisions shall be deemed not to have been written, the other general conditions remaining unaffected and retaining their full effect on the parties’ obligations.
16.3
In using the service, the user intends to comply with the conditions of using the Portail Altibus.com whose provisions shall be able to be consulted in the legal notification on www.noticelegale.com
The present contract shall be governed by French law. Any dispute arising from the performance of interpretation of the present contract shall, if possible, be settled by the parties in a friendly manner, but if they shall prove unable to do so, the Commercial Court Chambéry shall have jurisdiction, regardless of the presence of several defendants, or of an invocation of warranty.
